This information constitutes and regulates the conditions of use, the limitations on responsibilities and the obligations which the users of the Site published under the domain name www.presenceco.com accept and undertake to respect.
- “Site”, domain name www.presenceco.com made available to Internet Users.
- “User”, individual or legal entity which uses or browses the Site.
- “Contents”, all of the webpages which make up the domain name www.presenceco.com, which constitute the information and the services which Presence makes available to the Internet Users. It includes the messages, texts, photographs, graphics, icons, logos, technology, links, textures, drawings, sound and/or image archives, recordings, software, aspect, graphic design and source codes and, in general any type of material contained on the Site.
- “Hyperlink”, technique whereby a User can browse through different webpages on the Site or on the Internet, simply by clicking on the text, icon, button or indicator which contain the link.
- “Cookies”, technical resource for the traceability and monitoring of the browsing on Websites. They are small text files which are written on the User’s computer. This method has implications for privacy, thereforre Presence will duely and reliably give notice when they are introduced on the Site.
Conditions of use
Merely by using the Site you become a user of the Site, whether you are an individual or a legal entity, and this automatically implies the complete and full acceptance without reservation of each and every one of the clauses and general conditions included in the Legal Notice. If the User does not agree with the clauses and conditions of use of this Legal Notice, they must refrain from using the Site.
This Legal Notice is subject to changes and updates and as such the version published by Presence may be different every time the User accesses the Portal. As such, the User must read the Legal Notice every time they access the Site.
Through this Site, Presence provides the Users with access to and the use of different Contents published on the Internet by Presence or authorised third parties.
The User is bound and undertakes to use the Site and the Contents in accordance with the current legislation, the Legal Notice and any other notice or instructions made available to you, either through this legal notice or in any other place within the Contents of the Site, as well as in accordance with the generally accepted rules of coexistence, moral and good customs.
For such purpose, the User is bound and undertakes NOT to use any of the Contents for purposes which are unlawful, prohibited in the Legal Notice or by the current legislation, harmful to third party rights and interests, or which could in any way damage, put out of use, overload, deteriorate or impede the normal use of the Contents, the computer equipment or the documents, archives and all types of contents stored in any computer equipment owned or contracted by Presence, of other Users or of any Internet user (hardware and software).

Furthermore, according to this, the User shall not:
- Reproduce, copy, distribute, make available or in any other way publicly communicate, transform or modify the Contents, except with the express written authorisation from Presence, which is the owner of the corresponding rights, or when legally permitted.
- Delete, manipulate or in any other way alter the “copyright” and other relevant information of the reservation of rights of Presence or their owners, of the fingerprints and/or digital identifiers, or of any other technical means established for their recognition.
The User must abstain from obtaining and even from trying to obtain the Contents using means or procedures other than those which, as the case may be, have been made available to them for this purpose or have been indicated for this purpose on the Websites containing the Contents or, in general, those that are normally used on the Internet for this purpose, provided that there is no risk of harming or putting out of use the Site and/or its Contents.
All of the trademarks, commercial names or distinctive signs of any type which appear on the Site are owned by Presence or, if applicable, by third parties which have authorised their use, without it being considered that the use of or access to the Portal and/or to the Contents attributes to the User any right over said trademarks, commercial names and/or distinctive signs, and without any of the exploitation rights over, or which may exist over, said Contents being considered assigned to the User.
Equally, the Contents are the intellectual property of Presence, or if applicable of third parties, and as such the Intellectual Property rights are owned by Presence or by third parties who have authorised their use, who shall exclusively exercise their exploitation rights in any form and, in particular, the rights of reproduction, distribution, public communication and transformation.
The unauthorised use of the information contained on this Website, and harm to the Intellectual or Industrial Property rights of Presence or third parties included in the Site which have assigned contents, will give rise to the legally established liability.
Those persons who propose hyperlinks between their website and the Site must follow and fulfil the following conditions:
- Prior authorisation shall not be required when the Hyperlink only allows access to the home page, but it cannot reproduce it in any way. Any other form of Hyperlink shall require the express and unequivocal written authorisation from Presence.
- Frames shall not be created with or on the Presence Webpages.

- The Website which establishes the Hyperlink shall not contain unlawful information or contents, against generally accepted moral and good custom and public order, and cannot contain contents which violate any third party rights.
Availability of the Site
Presence does not guarantee the lack of interruptions or errors in the access to the Site, to its Contents, or that they are up to date, although it shall make its best efforts to avoid, correct or update them as is the case. As a result, Presence is not responsible for the damages or harm of any type caused to the User which is due to faults or disconnection in the telecommunications networks which lead to the suspension, cancelation or interruption of the Portal’s service during or before the provision.
Presence excludes, with the exceptions included in the current legislation, any liability for any type of damage which may be due to the lack of availability, continuity or quality in the functioning of the Site and of the Contents, by not complying with the expectation of use which the users may attribute to the Site and to its Contents.
The function of the Hyperlinks which appear on this Web is exclusively in order to inform the user about the existence of other websites which have information about the matter. Said Hyperlinks do not constitute any suggestion or recommendation.
Presence is not responsible for the contents of said linked Websites, for the functioning or use of the Hyperlinks or for the result of said links, and does not guarantee the absence of virus or other elements in them which could cause alterations to the computer system (hardware and software), documents or files of the user, excluding any responsibility for the damage of any type caused to the user for such reason.
The access to the Site does not imply an obligation on Presence to control the absence of virus, worms or any other harmful I.T. elements. It corresponds to the User, in any case, to have proper tools to detect and disinfect harmful computer programmes, and as such Presence is not responsible for the possible security errors during the provision of the Site’s service, or for the possible harm which may be caused to the computer system of the user or of third parties (hardware and software), the files or documents stored therein, as a result of the presence of virus on the user’s computer used for the connection to the services and contents of the Web, due to improper functioning of the browser or the use of versions which are not up to date.
Quality of the Site
Given the dynamic and changing environment of the information and services which are supplied via the Site, Presence makes every effort to ensure but does not guarantee absolute accuracy, veracity, reliability, usefulness and/or up-to-datedness of the Contents.
The information contained in the webpages which make up this Site is only for information, consultation, dissemination and advertising. Under no circumstances do they offer or give a binding or contractual undertaking.
Limitation of responsibility
Presence excludes any liability for the decisions which the User may make based on this information, and for the possible typing errors which may be contained in the Page’s documents and graphs. The information is subject to possible periodic changes without prior notice to its contents due to extension, improvement, correction or updating of the Contents.
All notifications and communications by Presence to the User through any means shall be considered effective for all purposes.
Availability of the Contents
The provision of the services of the Site and of the Contents, is in principle for an indefinite term. Presence is however authorised to end or suspend the provision of the service of the Site and/or of any of the Contents at any time. When reasonably possible, Presence shall give notice before the termination or suspension of the Site.

Presence is aware of the importance of the privacy of the personal data and as such has implemented a data processing policy aimed at providing maximum security in their use and collection, guaranteeing compliance with the current legislation on the issue and setting said policy as one of the basic pillars of the entity’s lines of action.
